1. Acceptance of Terms
By downloading, installing, or using FakeCam ("the Software", "the Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must uninstall the Software and discontinue use.
These Terms constitute a legally binding agreement between you ("User", "you") and FakeCam ("we", "us", "our"). You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Software.
2. Description of Service
FakeCam is a Windows desktop application that provides:
- A virtual webcam device that can be used by any application
- Video file playback (MP4, AVI) as a webcam feed with optional looping
- Static image display (PNG, JPG, BMP) as a webcam output
All processing is performed locally on your computer. No data is uploaded to our servers.
3. Software License
FakeCam is proprietary software. It uses third-party components: the virtual camera driver (softcam) is licensed under the MIT License, and the user interface uses Qt, which is licensed under the LGPL (Lesser General Public License).
You are granted a non-exclusive, non-transferable license to use FakeCam for personal use, subject to these Terms and the licenses of the underlying components. Commercial or professional use requires a separate license - please contact us to obtain one.
The third-party components (softcam, Qt) are governed by their respective licenses. You may not reverse-engineer, decompile, or disassemble the FakeCam application except as permitted by applicable law.
4. User Content and Responsibility
You retain full ownership of all video files, images, and other media you use with FakeCam. We do not claim any rights over your content. Since all processing occurs locally on your computer, we never have access to your files.
You are solely responsible for ensuring that the content you stream through the virtual camera does not violate any applicable laws, regulations, or third-party rights (including copyright, privacy, and publicity rights).
5. User Responsibilities
You agree to use the Software in compliance with all applicable local, national, and international laws and regulations. You are solely responsible for determining whether your use of FakeCam is lawful in your jurisdiction. You must not use FakeCam to deceive, defraud, or mislead others in any context where the authenticity of your webcam feed is legally or contractually required.
6. Prohibited Uses
You agree not to use the Software to:
- Impersonate another person or misrepresent your identity in contexts where it is illegal or harmful
- Stream copyrighted content without authorization
- Bypass identity verification or authentication systems
- Engage in fraud, harassment, stalking, or any form of illegal activity
- Use the Software in any way that could cause harm, damage, or legal liability to others
7. Intellectual Property
The FakeCam application, including its user interface design, icons, and documentation, is the intellectual property of its creators. The third-party components are governed by their respective licenses (MIT for softcam, LGPL for Qt).
The FakeCam name, logo, and related trademarks are our property. You may not use our trademarks without prior written consent, except as necessary to refer to our product in a factual, non-misleading manner.
8. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Software will meet your requirements, operate without interruption, be error-free, or be compatible with any particular hardware, software, or network configuration. We do not warrant that any defects will be corrected or that the Software is free of viruses or other harmful components.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAKECAM, ITS DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE.
In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the greatest extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless FakeCam and its developers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Software; (b) content you stream through the virtual camera; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of a third party.
11. Termination
You may terminate this agreement at any time by uninstalling the Software. Upon termination, your license to use the Software is immediately revoked.
Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive termination.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to the competent courts of France.
13. Severability and Waiver
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by updating the revision date at the top of this page.
Your continued use of the Software after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must uninstall the Software and discontinue use.
